Terms and Conditions 

1. These terms and conditions, as published on the website www.theluckylist.com.au amended from time to time (“Terms”), govern the terms of participation in The Lucky List Lottery (“Lottery”) operated by MSWA LIMITED (ABN 75 638 080 972) (“MSWA”).
2. Where it is lawful to do so, these Terms may be updated and re-published online at www.theluckylist.com.au. It is up to the participant to review the Terms prior to entering the Lottery.  MSWA does not warrant that the Terms remain unchanged between lotteries.
3. In Western Australia, lotteries are regulated by the Gaming and Wagering Commission of Western Australia’s Department of Local Government, Sport and Cultural Industries (“Gaming and Wagering Commission”).

Entry and Participants  

5. By purchasing a ticket in the Lottery, participants will be deemed to have read and agree to be bound by these Terms.
6. The following people and all who reside at their same residential address are prohibited from entering the Lottery:

• Urban List employees (and their immediate family and/or those living in the same household) of the Promoter, and its related entities, affiliates, subsidiaries, agencies and suppliers associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister or first cousin.
• MSWA Board Members;
• MSWA Executive Team Members;
• MSWA Head of Departments;
• MSWA Marketing Team Members;
• MSWA Information Systems Team and Ticket Fulfilment Staff;
• BDO Australia Directors and employees associated with the lottery draw; and
• any staff member who works on the MSWA Account from MSWA’s associated agencies (individually and together, “MSWA Affiliated Person”).

7. Participants must not be under the age of 18 years (“Underage Participant”)
8. Participants must not be residing outside of Australia at the time of purchasing any ticket, unless they are able to provide proof of an Australian address and/or Australian bank account. (“Internationally Based Participant”).   

Participant’s Information 

9. Name changes on tickets are not permitted, and therefore the onus is on the participant to ensure that they provide the correct information to MSWA upon the purchase of each ticket.
10. All participants must ensure their postal address is up to date when purchasing a ticket as address changes may not be possible or accommodated following the prize draws.
11. The records held by MSWA, as provided by the participant, shall be deemed as correct and final.

Tickets

12. MSWA reserves the right to refuse sale or refund tickets to an individual at their discretion.  The participant acknowledges and agrees that MSWA is not required to provide reasons for the exercise of its discretion to not refund a ticket.
13. Lottery ticket prices are set at $9 Australian Dollars per ticket.
14. A maximum of 30,000 tickets are available for sale.
15. If all of the 30,000 tickets are sold, then each ticket will have a 1 in 577 chance of winning a prize.
16. MSWA are not authorised to process ticket refunds without written approval from the Department of Racing, Gaming and Liquor. This process may take a number of weeks. Refunds cannot be offered after the final draws have begun.

Prize Draw Process 

17. MSWA’s auditors, BDO Australia, will attend all prize draws to ensure completeness and fairness of the draws.
18. The winners will be determined by a computerised random number generator which has been approved by the Gaming and Wagering Commission. Each ticket purchased in time has the same probability of winning any eligible prize.
19. If any MSWA Affiliated Person, Underage Participant, or Internationally Based Participant, enters the Lottery contrary to these Terms and wins a prize, they will be ineligible to receive that prize or any benefit from that prize (“Ineligible Prizes”).
20. There will be a redraw for those Ineligible Prizes by MSWA as soon as practicable in the same manner as the original draw occurred as described in these Terms, at a time and manner as approved by the Gaming and Wagering Commission (“Redraw”).  

Prizes 

21. The total combined retail value of all of the prizes is $55,000 as at the time of MSWA’s purchase of said quote.
22. There are three categories of prizes (particularised further in the Prize Specifics section of these Terms below), being the:
23. Early Bird Prize: where the prize is an Arrival Hall Package (valued at $15,000). There is only one Early Bird Prize.
24. Grand Prize: where the prize is an International Holiday Curated by Urban List (valued at $30,000) OR $30,000 cash. There is only one Grand Prize.
25. Other minor prizes: where there are 50 additional prizes made up of restaurant vouchers (valued at $200 each).
26. Each ticket purchased before the relevant sales close date referred to in the Key Dates section above will allow the participant a chance to win a prize in each of the prize categories.
27. In order to be eligible to win a relevant prize, a participant must purchase their ticket before the sales close date of that particular prize.
28. Due to state specific legislation, if a participant wins a cash prize and they are located in or a resident of the State of Victoria, MSWA will arrange for the winner to be provided with the equivalent value in gold bullion instead of cash.
29. All prize winners will be notified in writing by way of email or posted by way of registered post to the prize winner’s postal address within 5 days of winning.
30. To claim prizes, ticket purchasers agree to provide to MSWA, upon request, proof of:

• identity, including a 100-point identification check;
• an Australian address; and / or
• an Australian bank account (where the prize is cash or cash equivalent).

31. Prizes are awarded as per the name on the ticket.
32. Promotional images of the prizes are for display purposes only. Prizes awarded may not be exactly as illustrated.
33. Participants agree that where there is a manufacturer or other issue in respect of a Final Prize, prize winners must first contact the relevant supplier in respect of manufacturer or other warranties before contacting MSWA. 

Prize Draw Dates 

34. There are two prize draw dates referred to in the Key Dates section of these Terms above.
35. Notwithstanding the dates set out in the Key Dates section above, the relevant prize draws may be conducted earlier if all of the tickets have been sold.  If all of the tickets are sold before a relevant sales close date, then the remaining draws will all occur on the next scheduled draw date. 

Publicity and Privacy Policy  

36. By entering the Lottery, the participants who win any prizes agree to have their name and suburb published by MSWA or Urban List for publicity purposes.
37. Prize winners consent to videos, audio recordings, and photographs of them being used for reasonable promotional activities both in print, and on the internet including on social media platforms.
38. Participants acknowledge and agree that the names of all Early Bird Prize and Grand Prize winners will be published on the website within 48 hours of the relevant prize draw.
39. MSWA will not disclose any confidential or personal information to any person other than in accordance with these Terms and the MSWA privacy policy (“Privacy Policy”).  Where there is an inconsistency between these Terms and the Privacy Policy, participants agree that these Terms take priority.  For information on the Privacy Policy, visit theluckylist.com.au/privacy-policy or for a printed copy, call 1300 769 019.
40. By purchasing a ticket, participants agree to receive promotional materials for and/or from MSWA, Urban List and its related entities. 

Liability 

41. MSWA & Urban List and associated agencies accept no responsibility for any loss, damage, accident, death or injury resulting from the Lottery, or the use or misuse of any prize that may be won within the Lottery.
42. The participants agree that they will use any prize they may receive reasonably, and in accordance with the relevant manufacturer’s applicable recommendations.
43. All participants agree to release and indemnify MSWA & Urban List against any claim they may have in respect of all liability, cost, loss, damage, or expense arising out of acceptance of any prize or participation in the competition including (but not limited to) loss of income, personal injury, and damage to property and whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise. 

Delivery of Prizes  

44. Winners are ultimately responsible for claiming their prize, therefore participants are required to ensure that their postal address is up to date in the event that they are to win a prize and their prize is to be posted.
45. The Lottery is run primarily within, but is not exclusive to, Western Australia.  Prize winners may be required to provide an address in the Perth metropolitan area for local delivery, make alternative arrangements to collect the prize(s), or communicate directly with the supplier of the prize(s).
46. MSWA will not be liable for any additional shipping or postage costs that may be incurred in respect of relocating any prize outside of Western Australia.
47. The participant agrees to collect any prizes from a reasonable location around Western Australia at the reasonable direction of MSWA.  

Donation of Unwanted Prizes  

48. MSWA is a non-profit organisation (registered with the Australian Charities and Not-for-profits Commission) that provides vital support and services to people living with neurological conditions in Western Australia. MSWA accepts donations for the support of MSWA’s purpose and activities. In the event that a prize winner no longer wishes to receive a prize, that prize winner may donate the prize to MSWA by expressly informing MSWA of this intention at any point in time, including prior to delivery.

Prize Specifics 

49. Early Bird Prize: 

1. The Early Bird Prize winner(s) will win an Arrival Hall Package valued at $15,000, this includes a styling session with an in-house stylist.
   1. Following the prize draw, MSWA will pass the winners details to Arrival Hall to accept the prize.
   2. Only tickets purchased before Midnight, Sunday 8 June 2025 are eligible for the Early Bird prize.
   3. If all tickets are sold before Midnight, Sunday 8 June 2025 all prize draws will be completed on Monday, 9 June 2025.
   4. If tickets remain after the Early Bird sales close, only the Early Bird Prize draw will be completed on Monday, 9 June 2025.
   5. Each ticket purchased before the Early Bird sales close is also eligible to win the Grand Prize, including the winner of the Early Bird Draw. 

50. Grand Prize: 

1. The Grand Prize winner(s) will have the option to accept the International Holiday Curated by Urban List (valued at $30,000) OR $30,000 cash.
   1. The Grand Prize winner(s) will be given 48 hours from the time of notification to make their decision.
   2. If the Grand Prize winner(s) elects to take holiday, arrangements between the Flight Centre and the Grand Prize winner(s) will commence immediately to arrange the prize.
2. Holiday prizes must be accepted as awarded, and do not include travel insurance, spending money, an Australian passport or any other expenses unless otherwise stated.
3. Holiday winners are required to book and take their trip within 12 months of the prize draws.
4. If the winner wishes to negotiate an arrangement with Flight Centre, this negotiation will be solely between the winner and Flight Centre. MSWA will not enter this process. Flight Centre terms and conditions at help.flightcentre.com.au/s/article/booking-terms-conditions-au
5. To claim the prize, the winner will be required to complete a 100-point identification check and present their official winning ticket.
6. If the winner wishes to negotiate an arrangement with Flight Centre, this negotiation will be solely between the winner and Flight Centre. MSWA will not enter this process.

51. Early Bird Prize: 

1. The Early Bird Prize winner(s) will win an Arrival Hall Package valued at $15,000, this includes a styling session with an in-house stylist.
   1. Following the prize draw, MSWA will pass the winners details to Arrival Hall to arrange the prize.
   2. Only tickets purchased before Midnight, Sunday 8 June 2025 are eligible for the Early Bird prize.
   3. If all tickets are sold before Midnight, Sunday 8 June 2025 all prize draws will be completed on Monday, 9 June 2025.
   4. If tickets remain after the Early Bird sales close, only the Early Bird Prize draw will be completed on Monday, 9 June 2025.
   5. Each ticket purchased before the Early Bird sales close is also eligible to win the Grand Prize, including the winner of the Early Bird Draw. 

52. Fleur E-Gift Cards: 

1. MSWA will present all winners with an e-gift card from Fleur delivered to their nominated email address (or letter to their nominated address if an email address was not provided).
   1. Prizes must be accepted, as awarded, with no cash equivalents available.
   2. Winners will have 3 years to use their e-gift card from the date of issue. 

53. Zypher Lounge E-Gift Cards: 

1. MSWA will present all winners with an e-gift card from Zypher Lounge delivered to their nominated email address (or letter to their nominated address if an email address was not provided).
   1. Prizes must be accepted, as awarded, with no cash equivalents available.
   2. Winners will have 3 years to use their e-gift card from the date of issue.

54. Nieuw Ruin E-Gift Cards: 

1. MSWA will present all winners with an e-gift card from Nieuw Ruin delivered to their nominated email address (or letter to their nominated address if an email address was not provided).

   2. Winners will have 3 years to use their e-gift card from the date of issue. 

55. Light Years E-Gift Cards: 

1. MSWA will present all winners with an e-gift card from Light Years delivered to their nominated email address (or letter to their nominated address if an email address was not provided).
   1. Prizes must be accepted, as awarded, with no cash equivalents available.
   2. Winners will have 3 years to use their e-gift card from the date of issue.
